Oishii Match: Kawaii Snacks

These terms are the agreement between you and Charles Chang (Bao Bao Gaming Studios), based in Ontario, Canada, for playing Oishii Match: Kawaii Snacks ("the game"). Installing or playing the game means you accept them. If you do not, please do not play.

The short version

• Play the game, enjoy it, don't cheat.
• Petals, boosters and hearts are parts of a game, not property, and have no cash value.
• Buy things through Google Play or the App Store; refunds go through them.
• Cheating a leaderboard that pays prizes can cost you the prize and the account.
• We can change or stop the game, and we will not pretend otherwise.

Your licence to play

We give you a personal, non-exclusive, non-transferable licence to install and play the game on devices you control, for your own entertainment. You may not sell it, rent it, take it apart to extract its code or assets, or run modified copies of it.

Your account

You can play without an account. Linking a Google or Apple sign-in creates a Bao Bao Gaming Studios account, which is shared across our games — see the privacy policy for what that means for your data.

You are responsible for the sign-in you link and for what happens under it. One account per person. Your display name is shown to other players on leaderboards, and we may change a name that is offensive, impersonates someone, or is chosen to mislead.

You can delete your account at any time from within the game, or by following the account deletion instructions. Deleting removes your progress in every one of our games that uses the same account, and cannot be undone.

Petals, boosters and hearts

The game contains virtual items: petals, boosters, hearts, unlimited-hearts time and ad-free time. They exist only inside the game.

• They are licensed to you for use in the game, not sold to you as property.
• They have no monetary value and cannot be exchanged for money, transferred between accounts, or sold.
• They can be lost if you delete your account, and they end if the game ends.
• We may change what items cost, what they do, and how many a level gives, as part of balancing the game.

Purchases and refunds

Real-money purchases are handled by Google Play or the Apple App Store, under their terms and with their payment methods. We never see your card details.

Purchases deliver immediately and are final, except where the law gives you a right to cancel, or where the store's own refund policy applies. Refunds are requested from the store you bought from, not from us — they took the payment and they are who can return it. If a purchase does not arrive in your game, contact us and we will put it right.

If a purchase is refunded or charged back, we may remove the items it paid for, including anything already spent.

Blitz, leaderboards and prizes

Blitz rounds are scored on our servers by replaying your moves, so a score that could not have happened is not accepted. Leaderboards may award prizes.

Using modified clients, automation, multiple accounts, or any means of submitting a score you did not play, may cost you the score, any prize, and the account. Our decision on whether a score is genuine is final, and we would rather explain it than hide it — ask and we will tell you what we saw.

Prizes are in-game items unless stated otherwise. Where a prize has conditions, they are shown before you enter.

Playing fairly

Do not attempt to break, overload or gain unauthorised access to the game or its servers; do not use another player's account; do not choose a display name that harasses, impersonates or offends. We may suspend or close an account that does.

Children

The game is not directed at children under 13, and we do not knowingly collect their personal information. If you believe a child has created an account, contact us and we will remove it.

Changes, availability and ending

We may update the game, change its content and balance, or add and remove features. We may stop offering the game entirely; if we do, we will give notice in the game where we reasonably can.

We do not promise the game will always be available or free of faults. It is provided as it is, without warranties beyond those the law requires and does not allow us to exclude.

You may stop playing at any time. We may end your licence if you break these terms.

Our responsibility

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Otherwise, and to the extent the law allows, our total liability to you relating to the game is limited to what you paid us for it in the twelve months before the claim, and we are not liable for indirect or consequential loss, or for lost virtual items.

Some places do not allow these limits. Where that is so, they do not apply to you.

Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you live elsewhere, you keep the consumer rights your own country gives you.

Changes to these terms

We may update these terms. The date at the top says when they last changed, and continuing to play after a change means you accept it. If a change matters, we will say so in the game rather than only here.
